到底誰的錯?承包商最愛玩的 7 個套路:每個新移民都要懂的裝修雷區!⚠️🔥
在美國做裝修,本來應該是讓家變更好,但對很多新移民來說,卻像是走入一場「靠運氣」的考驗 🎲。
有些承包商遲到、失蹤、亂報價、偷工減料、突然加價、做一半跑掉……
甚至還會像我第二篇提到的「陳包商+趙畫圖師」那樣,讓屋主不知該哭還是該笑 😂。
但今天,我們不講八卦 —— 我們要講的是:
🛑 到底哪些情況是承包商的錯?
🛑 哪些情況是屋主可以合法停付?
🛑 哪些情況需要立刻中止施工?
以下七種,是美國最常見的 contractor 糾紛,每一條都是華人社區最容易踩到的坑。
只要你讀完,你就會立刻知道:
「遇到問題時,我該挺還是該退?」
1️⃣ 套路一:做一半不做了 —— 最常見、最危險 🧨
這是 contractor 糾紛之王。
症狀:
- 原本每天都來,後來三天來一次 😒
- 說要過來卻一直 no show,電話不接
- 理由永遠是「材料沒到」、「工人生病」、「明天一定來」
法律怎麼看?
如果 contractor 無正當理由停工,代表:
✔ 屬於 breach of contract(違約)
✔ 屋主可停付
✔ 甚至可終止合約
千萬不要繼續給錢。給了就回不來了。
2️⃣ 套路二:追加費用(Change Order)但沒有書面記錄 💸
很多新移民都遇過:
「這個牆內有問題,要多收 $2,000。」
「你這個 tile 太難貼,要補工錢。」
如果沒有書面 Change Order:
✔ 你可以拒絕付款
✔ 承包商無法用口頭追加費用
美國法律超級重視文件。白紙黑字以外的一概不算。
3️⃣ 套路三:報價超低,開工後一直加碼(華人最常中)💀
這就是所謂的 “Lowball Bid”。
開價超便宜,讓你以為賺到了,但等你進入施工後,他會:
- 說這不是 original scope
- 說材料漲價
- 說你家「特殊情況」要加錢
這種 contractor 的策略就是:
先讓你無法脫身,再慢慢把錢拿走。
遇到這種,只有一句話:
🛑 趕快停工,立刻終止契約。
4️⃣ 套路四:沒有 Permit 就偷做工程 🚫🏗️
很多華人 contractor 最愛講:
「沒人查啦!」
「靠運氣啦!」
「Permit 很麻煩啦!」
但你要知道 ——
⚠️ 如果沒有 Permit → 屋主負責
⚠️ 捉到是你被罰
⚠️ 出事是你賠,保險不理
這種 contractor 最危險,不要用。
5️⃣ 套路五:消失不見的 contractor(突然人間蒸發)🕳️
比偷工減料更可怕的是:他直接消失。
常見模式:
- 拿了 deposit
- 來 1–2 天
- 再也沒出現
法律怎麼看?
✔ 明確違約(breach)
✔ Deposit 大多可追討
✔ 可直接走小額法庭 small claims
但注意:他如果沒錢、沒資產,你贏了也拿不到錢。
6️⃣ 套路六:保險不完整(尤其是沒有 Completed Operations)📄
這點 90% 新移民不知道。
承包商的保險分兩種:
- General Liability(一般責任)
- Completed Operations(完工後責任)
很多 contractor 只有第一種。
但真正重要的是「完工後責任」。
因為:
✔ 牆後電線漏電
✔ 管線爆裂
✔ 地板翹起
✔ 結構崩壞
—— 都是「施工 後」才發生。
沒有 Completed Ops = 你完全沒有後盾。
7️⃣ 套路七:做到一半要求你「先全部付款」💰⚠️
這是詐騙 90% 的共同特徵。
contractor 最喜歡說:
「材料要先付完」
「工人要先付薪水」
「我們公司政策是先付清」
記住:
✔ 在美國,永遠不要付超過 1/3 以上的工程款。
付太多就是:請 contractor 跑掉。
📌 結論:遇到問題前,先問三句話
每次你懷疑 contractor 有問題時,請問自己:
- 工作有沒有實質完成?(Substantial Performance)
- 有沒有書面合約、書面 Change Order?
- 承包商有沒有資格(license+insurance)?
只要其中一項不 OK,屋主就可以停付,甚至終止契約。

2️⃣ Scam #2: Surprise “extra charges” without a written Change Order 💸
If it’s not in writing, it does not exist.
✔ Homeowner can refuse payment
✔ Contractor cannot enforce verbal add-ons
3️⃣ Scam #3: Lowball bid → massive price increases later 💀
This is intentional manipulation.
- Cheap price to get you in
- Then constant upcharges
- Pressure tactics to continue paying
Solution:
🛑 Stop the job immediately.
4️⃣ Scam #4: Doing work without a permit 🚫
No permit = homeowner’s liability.
✔ Fines go to YOU
✔ Insurance may deny claims
✔ City can require demolition or redo
5️⃣ Scam #5: Contractor disappears after deposit 🕳️
Common pattern:
- Takes deposit
- Works 1–2 days
- Never returns
✔ This is breach
✔ You can file small claims
✔ But recovery depends on their assets
6️⃣ Scam #6: Incomplete or missing insurance (especially lack of Completed Operations) 📄
General Liability is NOT enough. You need contractors with:
- General Liability
- Completed Operations
Most damage happens AFTER the job is done.
7️⃣ Scam #7: Asking for full payment before finishing 🔥
Huge red flag.
Rule in the U.S.:
✔ Never pay more than one-third upfront.
📌 Final Checklist: Ask These 3 Questions
- Was the work substantially completed?
- Do I have written contracts and Change Orders?
- Is the contractor licensed and insured?
If any answer is “No,” the homeowner may legally withhold payment.
