孩子監護權是美國離婚案件中最敏感、最重要的主題之一。
但很多人不清楚兩個核心概念：
Legal Custody（法律監護）
Physical Custody（實際監護）
它們完全不同、處理的事情不一樣，但很多人把兩者混在一起。
一、Legal Custody（法律監護）是什麼？
Legal Custody 指的是「誰有權決定孩子的重要事情」。包含：
- 學校與教育（讀哪一間、IEP 等）
- 醫療（手術、治療、疫苗）
- 宗教
- 護照與國際旅行
- 心理諮商
Legal Custody 有兩種：
- Joint Legal Custody（共同法律監護）
- Sole Legal Custody（單獨法律監護）
美國法院通常偏向 共同，除非：
- 一方完全不適合參與決策
- 有家暴
- 濫用物質
- 失聯
二、Physical Custody（實際監護）是什麼？
Physical Custody 指的是：
孩子實際跟誰住？在誰家花最多時間？
這也分兩種：
- Joint Physical Custody（共同實際監護）
- Sole Physical Custody（單獨實際監護）
⚠️ 共同實際監護 ≠ 一定要 50/50。
美國法院只要求「合理」，不是數字完美對半。
常見安排：
- 3–4 天在媽媽家、3–4 天在爸爸家
- 兩週輪替
- 上課日住一邊、週末住另一邊
三、Joint Custody = Legal + Physical 的組合
很多人把 “Joint Custody” 誤解成一種監護權，其實它是組合：
- Joint Legal + Joint Physical
- Joint Legal + Sole Physical
美國大多數離婚家庭是：
Joint Legal + 主要實際監護（Primary Physical）
四、Sole Custody 是不是代表另一方不能見孩子？
不是。
Sole Physical Custody 意味著：
孩子住主要監護人那邊，但另一方通常有探視權（visitation）。
除非有以下情況：
- 嚴重家暴
- 虐兒
- 濫用毒品
- 高度危險
否則法院通常會讓另一方仍可接觸孩子。
五、法院怎麼判？（最大原則）
美國所有州的監護權判決都有同一個核心原則：
➡️ The Best Interest of the Child（孩子最佳利益）
法院會看：
- 誰比較能提供穩定環境
- 誰照顧孩子比較多
- 父母關係是否安全
- 父母是否合作
- 孩子的年齡與需求
法院不是在「獎勵」或「懲罰」父母，而是在保護孩子。
六、無證移民能不能有監護權？（完全可以 ✔）
無證移民可以有 Legal & Physical Custody。
家庭法院不查身分、不通報 ICE。
- 孩子是美國公民 → 不影響
- 父母是無證 → 一樣可申請監護權
- 法院不會因移民身分削弱監護權
監護權只看「誰對孩子最好」與安全性。
七、父母住不同州怎麼辦？
適用 UCCJEA（跨州監護法）：
- 孩子過去 6 個月主要居住地的州負責判決
意思是：
不是父母住哪州說了算，而是孩子住哪州說了算。

- 孩子資訊表
- child support worksheet
- 父母雙方收入資料（用於 support 計算）
九、總結：Legal vs Physical 要分清楚
Legal Custody = 誰做決策
Physical Custody = 孩子跟誰住
兩者各自獨立，但會一起決定孩子的完整安排。

4. Does sole custody mean no visitation?
No — most parents still have visitation.
5. How courts decide custody
Best Interest of the Child standard:
- Stability
- Safety
- Parental cooperation
- Past caregiving
6. Undocumented immigrants
They can have full custody rights.
Court does not check immigration status.
7. Parents living in different states
UCCJEA applies → child’s home state (last 6 months) controls.
