這是 McKinney-Vento 最強大的保護之一:School of Origin(原校保留權)。

🏫 一、School of Origin 是什麼?
School of Origin = 小孩在「失去固定住所當下」就讀的那一所學校。
例如:
- 住在 RV 之前,小孩在 Fremont 某小學 → 這就是 SOO
- 住 motel 時,小孩正在 Hayward 上課 → 這就是 SOO
即使你後來搬走、住回租屋,原校仍然是 valid 的。
🚐 二、住 RV 期間的小孩 —— 原校可以保留嗎?
可以,因為 McKinney-Vento 的定義是:
所有沒有固定、適當、且安全住所的學童 → 都屬於無家可歸(homeless under MV)。
住 RV = 沒有固定住所 → 完全符合 MV。
所以 RV 期間的小孩有權選擇:
- ✔ 留在原本的學校(School of Origin)
- ✔ 或轉到實際所在地的新學校(local school)
家長決定,學校不能逼你轉。
🏠 三、那如果「找到租屋」了,要轉學嗎?
不一定。
McKinney-Vento 明確規定:
即使家庭已經搬入固定住房,孩子仍可選擇繼續就讀 School of Origin,直到該學年結束。
也就是說:
- ✔ 當學年可以繼續留在原校
- ✔ 不需要因為搬入 apartment 就被強迫轉學
家長說留就留。
🚌 四、搬家之後,學區要不要負責交通?
一般規則:
- 只要孩子仍符合 McKinney-Vento(例如還在過度過渡住所) → 學區必須提供交通。
- 如果家庭已經搬入「固定住房」 → 學區可以「選擇」提供交通,但法律不強制。
所以:
如果你剛從 RV 搬進 apartment:
- ➡️ 如果認定仍在「過渡期」 → 交通仍由學區出
- ➡️ 如果被認定已脫離 MV → 原校保留,但交通不一定給

📅 五、原校保留權(SOO)可以保留多久?
直到該學年結束。
也就是說,如果你在 10 月搬家 → 孩子可以在整個學年(到隔年 6 月)繼續留在原校。

Many families living in RVs, motels, cars, or doubled-up situations ask the same question once they finally secure a rental:
“Now that we have stable housing, does my child have to transfer schools?”
In many cases: No — the child can stay in the School of Origin.
🏫 1. What is the School of Origin?
The School of Origin is the school the child was attending at the time they lost fixed housing.
Even after moving into a rental, the same school remains the School of Origin.
🚐 2. During RV living — can the child keep their original school?
Yes. RV living qualifies as “homeless” under McKinney-Vento.
Therefore, the child has the right to choose:
- ✔ Stay in the School of Origin
- ✔ Or attend the local school where the RV is parked
Parents decide, not the district.
🏠 3. After moving into a rental — must the child transfer?
Not necessarily.
McKinney-Vento requires that:
A child may remain in the School of Origin for the rest of the school year, even after gaining permanent housing.
🚌 4. Who pays for transportation?
- If the family still qualifies under McKinney-Vento → the district must provide transportation.
- If the family has transitioned to stable housing → transportation is optional (not required).
