三州比較:差別在哪?

加州(California)

加州過去的最低責任額相對偏低(例如曾經是 15/30/5),即使近年有提高,路上仍有不少駕駛只買到最低額度。

如果肇事者的身體傷害責任額度只有 $30,000,你最多可能只能從對方保險拿到 $30,000。

那剩下的 $230,000 呢?

很可能就變成你的缺口——除非你有買 UM/UIM(無保險/低額度駕駛保險)。


德州(Texas)

德州的最低責任額通常比加州過去的最低額度高,但仍有不少人只買法律最低標準。

而且德州允許你以書面方式拒買 UM/UIM。

I keep distance.
I avoid speeding.

But one day I realized something uncomfortable:

I can control how I drive. I cannot control who hits me.


A Simple Scenario

You’re driving home from work.

At an intersection, another driver runs a red light and crashes into you.

You suffer injuries requiring surgery and physical therapy.

Total medical cost: $220,000

Lost wages: $40,000

Total loss: $260,000

The other driver’s insurance?

Minimum liability limits.


How the Three States Compare

California

Historically, California required very low minimum liability limits (previously 15/30/5).

Even with recent increases, many drivers still carry minimal coverage.

If the at-fault driver has only $30,000 bodily injury limits, you may recover only that amount from their insurer.

The remaining $230,000?

That gap becomes your problem — unless you carry UM/UIM coverage.


Texas

Texas minimum limits are higher than California’s old limits, but many drivers still carry only the legal minimum.

Texas allows drivers to reject Uninsured/Underinsured Motorist coverage in writing.

High-speed highway accidents can result in significant injury costs, often far exceeding minimum limits.

Without UM/UIM, you may need to pursue the individual personally — and collecting may be difficult.


Arizona

Arizona minimum liability limits exist, but medical costs can quickly exceed them.

UM/UIM coverage is optional and can be rejected.

Again, if the at-fault driver is underinsured, the financial gap shifts to you.


“But I Can Sue Them, Right?”

Yes, you can.

But winning a lawsuit does not guarantee collecting money.

If the other driver has:

  • No assets
  • No savings
  • No property
  • Limited income

You may win a judgment — and still recover very little.

This is known as a “judgment-proof” defendant.


Where UM/UIM Changes the Outcome

If you carry $250,000 in Uninsured/Underinsured Motorist coverage:

  • The at-fault insurer pays their limit (e.g., $30,000)
  • Your insurer may pay up to your UM/UIM limit (subject to policy terms)

Instead of chasing an individual with no assets, you access your own contractual protection.
