什麼是 EB-3 護士移民?
EB-3(Employment-Based Third Preference)是美國的「雇主擔保」移民類別之一。
其中,Registered Nurse(RN) 被列為「Schedule A」職業,代表:
- 美國政府預設此職業長期短缺
- 雇主可以跳過 PERM 勞工市場測試
- 流程相對其他職業簡化
但簡化 ≠ 沒門檻。
誰「可以」考慮 EB-3 護士?
✅ 類型一:人在境外的海外護士
- 已完成護理學歷(國外)
- 通過 CGFNS / NCLEX(或可通過)
- 由美國醫院或醫療機構願意擔保
- 走「領事程序(Consular Processing)」
👉 這是最常見、風險最低的 EB-3 護士類型。
✅ 類型二:在美國、但「身分一直合法」的人
- 例如:F-1 學生 → 合法畢業
- 有合法停留紀錄

This is critical, because EB-3 nurse immigration is NOT a solution for undocumented status. It is a structured, rule-based immigration pathway with strict eligibility requirements.
What Is EB-3 Nurse Immigration?
EB-3 (Employment-Based Third Preference) is a U.S. employment-based immigration category.
Registered Nurse (RN) is classified as a Schedule A occupation, which means:
- The U.S. government recognizes a long-term labor shortage
- Employers can skip the PERM labor certification process
- The process is more streamlined compared to many other jobs
Simplified does NOT mean automatic.
Who Can Consider EB-3 Nurse Immigration?
✅ Group 1: Foreign-Trained Nurses Outside the U.S.
- Completed nursing education abroad
- Passed or eligible to pass CGFNS / NCLEX
- Have a U.S. healthcare employer willing to sponsor
- Apply through consular processing
👉 This is the most common and lowest-risk EB-3 nurse pathway.
✅ Group 2: Individuals in the U.S. With Continuous Legal Status
- For example: F-1 students who maintained lawful status
- No unlawful presence history
- Eligible for Adjustment of Status (AOS)
Important: This does NOT include undocumented or overstayed cases.
Who Is Not a Good Fit for EB-3 Nurse Immigration?
❌ Undocumented Individuals
- Unlawful presence records
- Possible 3-year or 10-year reentry bars
- Generally ineligible to adjust status inside the U.S.
EB-3 does not erase unlawful presence.
❌ Nursing Students Without Work Authorization
- Schools do not sponsor green cards
- Graduation does not equal work authorization
- No legal work status = no employer sponsorship
What Does EB-3 Nurse Immigration Actually Require?
Three Core Requirements
- 📄 Verified nursing education and credentials (CGFNS / NCLEX)
- 🏥 A U.S. employer willing to sponsor
- 📍 A legally valid immigration process (consular or adjustment)
All three are required.
Why Are Expectations Around EB-3 Nurses Often Unrealistic?
