🕑 一、什麼是 Reporting Time Pay(報到工時)?

當你依照排班到公司,卻沒有上滿班,公司必須付你工時補償。

加州規定:

  • 來上班 → 至少要付 2 小時
  • 最多需補到排班工時的 1/2

例子:

  • 你排班 8 小時 → 最少給 4 小時工資
  • 你排班 4 小時 → 最少給 2 小時工資

如果公司叫你:「今天沒生意、提早回去」→ 要付 Reporting Time Pay


📞 二、什麼是 On-Call?公司能不付錢嗎?

On-Call 的定義:

  • 公司要求你待在手機附近
  • 隨叫隨到
  • 不得離開某個距離範圍
  • 不得喝酒、不得安排私人活動

如果以上情況成立 → 必須付 On-Call Pay(待命工時)

如果只是說:

「等電話,我們看情況」

這有可能仍屬於 On-Call,視限制程度而定。


⏱ 三、On-Call 工資要怎麼算?

加州法院判決(Ward v. Tilly’s, 2019)確認:

只要 On-Call 對你的自由造成限制 → 雇主需要付工資。

常見計算方式:

  • 受限制的時間 → 計為工時(Hourly Rate)
  • 輕度待命 → 可給 On-Call Pay(固定津貼)

💰 五、Reporting Time Pay 要付多少?(2025)

最少 2 小時
最多補到你排班時數的一半。

例子:

  • 排班 8 小時 → 最少給 4 小時
  • 排班 6 小時 → 最少給 3 小時
  • 排班 3 小時 → 最少給 2 小時

公司不能只給你 1 小時,也不能給你 30 分鐘。


📌 六、「分段排班」會不會有 Reporting Time Pay?

公司常用兩段班(split shift)規避工資

  • 下午 5–8 點

這種情況要看「你是否有到場、是否被遣返」。
