🎒 住 RV 想進「好學區」
哪些做法合法？哪些會被當成 fraud？（一次說清楚）
很多家長想讓孩子讀好學區（好老師、資源多、升學率高），但如果買不起房、租不到房，又不想借高風險的假地址，就會問：
「那我住 RV 可以嗎？這樣算 fraud 嗎？」
「停在學區附近，就能入學嗎？」
這篇文章清楚整理「合法 vs. 違法」的界線，不管你在加州、德州、紐約、佛州都適用。
🟢 一、完全合法：住 RV，只要孩子真的睡在學區內
只要孩子晚上真正睡在那個學區內，即使住房是：
- 🚐 RV（路邊停放）
- 🏕 RV park / campground
- 🏡 停在朋友家 driveway
- 🛣 designated overnight parking zone
這些都是 合法住所，沒有 fraud。
美國教育法不是看你是不是房主，而是：
學童實際在哪裡睡覺。
所以只要你真的住在該學區，「住 RV」就是合法的入學資格。
哪怕是 Palo Alto、Cupertino、Fremont Mission、Plano ISD、NYC D2，都一樣。
🔵 二、合法但常被誤會：搬家、過家、臨時寄住（短期）
只要孩子晚上真的睡在那裡，都合法：
- 🛌 暫住親戚家
- 🧳 過渡時期的 sofa-surfing
- ⏳ 正在找房子 → 暫住同學家
- 🔥 租屋不穩 → 被迫住在未計畫地點
這些都是 McKinney-Vento 保護下的「過渡住所」（transitional housing）。
學校不能禁止，也不能要求租約和水電帳單。
這絕對不是 fraud。
🟡 三、灰色地帶：住在學區附近「但不是每晚都睡」
灰色案例包括：
- 🚐 RV 偶爾停在學區內，但大部分時間睡別處
- 🏠 住在 A 區，但用 B 區朋友家的 driveway 當 RV 停點（實際沒睡）
- 🏡 孩子偶爾在 B 區睡，但主要睡 A 區
重點：孩子的「majority nights」在哪裡？
如果學校調查，發現孩子主要睡在別的城市，就會被要求轉學。
這類通常不會被處罰，但會被視為：
「你不屬於這個學區。」
不算 fraud，但不穩定。
🔴 四、明確違法的 fraud（會被抓到、會被罰）
以下是全美學區都列為「fraud」的行為：
❌ 1. 完全不住該學區 → 用 RV 當假地址
- RV 停在學區外，但填了學區內的地址
- RV 明明停在 Hayward，但地址填 Cupertino
這是 100% fraud。
❌ 2. 假借地址、但孩子從來沒有住那裡
- 借親戚地址，但孩子完全沒住過
- 借朋友地址，但每天通勤 2 小時
學區會看：孩子早上 / 晚上在哪裡上下學？
如果與地址不符 → 會被要求轉學。
❌ 3. 用 Airbnb / Motel 當「短期假地址」
例子：
- 租 Airbnb 7 天 → 入學 → 結束 → 回原本住址
- 租 motel 2 週 → 入學 → 然後搬回舊家
學區完全知道這種手法，已列為非法。
❌ 4. 搬回原本城市 → 但地址不更新（最常被抓）
全美最常見的 fraud：
入學時住在該學區 → 學年中搬走 → 地址不更新。
這一種被抓到的時候最多，家長要補繳整年學費（out-of-district tuition）。
例如：
- Monta Vista HS：一年 $18,000
- Palo Alto USD：一年 $22,000
- NYC specialized HS：上看 $20,000+
不是罰款，是「補繳學費」。
🔍 五、住 RV 選好學區，怎樣才算「真正合法」？
只要符合兩句話：
1️⃣ 孩子是真的睡在這個學區裡
2️⃣ 你可以描述孩子「夜晚主要居住地」
就完全合法，沒有 fraud。
例如：
- 🚐 RV 停在 Cupertino 某條街
- 🚐 在 Palo Alto 每晚都睡在 RV park
- 🚐 在 Fremont Warm Springs 附近的 driveway
100% 合法入學。
🧭 六、家長常問：學區會怎麼查？
通常會用這些方式：
- 🚗 早上校車接送位置
- 🚶♂️ 小孩上下學的主要方向
- 📬 郵件是否收得到
- 📞 臨時家訪（不常見）
- 👀 鄰居檢舉（最常見）
學區不會每天查，但搬家後仍用舊地址 → 幾乎一定會被抓。

1️⃣ 住 RV，但半夜可能換地方，可以嗎？
可以，只要大部分夜晚都在該學區。
2️⃣ 孩子偶爾睡朋友家，那算嗎？
看 majority nights。
3️⃣ 我可以用 RV 過夜點當地址嗎？
可以，合法。
4️⃣ 我只停一星期，之後搬走可以嗎？
不建議，會被視為 fraud。
5️⃣ 如果真的很窮 → RV 是唯一選擇呢？

“If we live in an RV near a good district, is that legal?”
“Can we park the RV there and enroll?”
This article explains what is fully legal, what is a gray area, and what is considered enrollment fraud.
🟢 1. Fully Legal: Child truly sleeps in the district
If the child genuinely sleeps inside the district boundaries — even in:
- 🚐 RV parked on a public street
- 🏕 RV park / campground
- 🏡 A friend’s driveway
- 🛣 Overnight parking zone
This is 100% legal.
U.S. school districts care about:
Where the child sleeps at night.
Not whether you own or rent a home.
🔵 2. Legal but often misunderstood: temporary stays
- Staying with relatives
- Couch-surfing
- Short-term stays while searching for housing
- Emergency temporary housing
These fall under McKinney-Vento as transitional housing and are not fraud.
🟡 3. Gray zone: sometimes sleeping there, sometimes not
- RV parked in the district only occasionally

- Driveway parking without actually sleeping there
If majority of nights are outside the district → the district may deny enrollment.

You are legal if:
