📬⚠️ 離婚文件送達指南：對方不收、不開門、拒簽時怎麼辦？
在美國離婚要成功，第一步是合法送達（service of process）。
但現實中，很多人遇到：
- 對方不開門
- 對方拒收文件
- 故意閃避送達員
- 不肯提供住址
- 搬家、失聯
好消息：美國法院提供好幾種送達方式，對方不能故意「不簽、不收」來阻止離婚。
一、最基本：Personal Service（親自送達）
法院最喜歡、最優先的方法：
- 由第三方（不是你）親自把文件交給對方
- 可以是 Sheriff、Process Server、18 歲以上的朋友
重要：對方「拒絕簽字」不影響送達成功。
文件交到手或放在腳邊 → 就算完成送達。
二、對方拒收怎麼辦？（仍算送達成功）
法律只要求「交付」，不要求「願意接」。
例子：
- 對方說：不要、我不收 → 放在他面前即可
- 對方揮手拒收 → 丟在地上也可
- 對方躲在後面 → Process server 可拍照、記錄
拒收文件 ≠ 不算送達。
三、對方一直不開門？（Substituted Service）
如果對方故意不開門，有些州允許：
- 留給同住成年人
- 貼在門上
- 寄掛號信
- 搭配郵寄的 2 種方式
每個州不同，但大部分都有替代機制。
四、Mail Service（郵寄送達）可行嗎？
視州而定。
常見規定：
- 需要「Sign + Return Receipt」
- 對方要簽收（但如果拒簽 → 必須改用其他方式）
郵寄風險高，但可作為輔助。
五、找不到對方怎麼辦？（Service by Publication）
如果真的失聯、美國找不到人，也沒有親友可聯繫：
法院允許公告送達。
流程包括：
- 證明你已努力搜尋（due diligence）
- 申請法院批准公告
- 在報紙或指定網站刊登公告
- 公告期結束後 → 視同送達
接著即可申請 Default Judgment。
六、對方在別州 / 別國？
仍然可以送達。
- 跨州：可聘用當地 process server
- 跨國：依 Hague Convention 或該國規定
⚠️ 離婚可以跨州申請，只要你符合「居住要求」。
七、無證移民能被送達嗎？會不會引來 ICE？
完全不會。
家庭法院：
- 不查身份
- 不通報 ICE
- 不會因你送達文件而觸發移民後果
無證移民也能合法送達、合法離婚。
八、送達後，對方不回應怎麼辦？
只要送達成功並超過州規定時間（20～60 天），你就可以：

美國法律非常清楚：
你負責送達對方；
對方是否配合，是他自己的選擇。
拒收、不開門、失聯，都不會阻止你完成離婚。

To start a divorce in the U.S., you must legally “serve” your spouse. But many people face:
- Refusal to accept papers
- Avoiding the door
- Disappearing
- Not providing an address
- Moving out of state
Good news: A spouse cannot stop the divorce by avoiding service.
1. Personal Service
A third party (sheriff, process server, or adult) hands the papers to the spouse.
Refusing to take the papers does NOT stop service.
2. Refusing to accept papers
If the process server places the papers near the spouse, service is complete.
3. Substituted Service
If the spouse avoids the door:
- Leave with another adult in the home
- Tape to the door (some states)
- Mail + posting (combined methods)
4. Mail Service
Allowed in some states, usually requiring signed receipt.
5. Service by Publication
Used when the spouse cannot be located:
- Prove due diligence
- Request court approval
- Publish in newspaper/website
6. Out-of-state or international service
Still possible via process servers or Hague Convention rules.
7. Undocumented immigrants
Family courts:
- do NOT check immigration status
- do NOT report to ICE
8. After service: no response = default
If the spouse does not file an Answer, you may request a Default Judgment.
9. Summary
Avoiding service does not stop a divorce.
